Crown Wallet
1. INTRODUCTION
1.1. Crown is the issuer of the Crown Wallet.
1.2. These Terms and Conditions contain the provisions which apply to use of the Crown Wallet by a Member of the Crown Melbourne Casino.
1.3. Capitalised terms used in these Terms and Conditions are defined in clause 11.
1.4. By becoming a Member and continuing to hold a Membership or otherwise using the Crown Wallet, you agree that you have read, understood and accepted the terms and conditions and you must comply with the Terms and Conditions at all times.
1.5. Crown may amend these Terms and Conditions from time to time. Crown will make the amended Terms and Conditions available on the Website.
1.6. It is your responsibility to ensure you review any amendments or updates to the Terms and Conditions.
1.7. These Terms and Conditions are subject to the requirements of any applicable law and / or requirements or directions of any regulatory authority.
1.8. Notwithstanding anything in these Terms and Conditions, Membership of the Crown Melbourne Casino remains subject to the Crown Rewards Rules.
2. CROWN WALLET AT CROWN MELBOURNE CASINO
2.1. The issue and use of your Card, and the establishment of your Crown Wallet, is subject to the Crown Rewards Rules and these Terms and Conditions.
2.2. To use your Crown Wallet, funds must be deposited into your Crown Wallet in accordance with clauses 3 and 4:
2.2.1. at the Crown Melbourne Casino cashier; or 2.2.2. at a dedicated buy-in table; or
2.3. Subject to these Terms and Conditions, these funds will then be available as credits for play using your Card at an electronic gaming machine, automated table game or table game and in accordance with the Crown Melbourne policies and rules.
2.4. Crown does not accept contactless payments, credit cards or pre-paid cards of any kind (for example, gift cards).
2.5. Any of your winnings from the Crown Melbourne Casino can be credited to your Crown Wallet. If credited to your Crown Wallet, these funds will be available for gaming, or can be withdrawn in accordance with clause 4.
3. FUNDING YOUR CROWN WALLET – IN PERSON AT CROWN MELBOURNE CASINO
3.1. You may, subject to the Terms and Conditions, fund your Crown Wallet at the Crown Melbourne Casino cashier or at a dedicated buy-in table using:
3.1.1. cash; 3.1.2. your Debit Card; 3.1.3. (at the Crown Melbourne Casino cashier only) your Deposit Account (if applicable).
3.2. By authorising a Transaction using your Debit Card at the cashier, you represent and warrant to Crown that:
3.2.1. the Transaction is with a Debit Card that has been issued to you personally; 3.2.2. the Transaction will not involve the withdrawal of money from an account which is overdrawn; and 3.2.3. the use of your Debit Card to fund gaming activity does not contravene any law or the terms and conditions imposed on the use of your Debit Card by the issuer.
3.3. Surcharges will apply to Debit Card Transactions at the cashier. Information regarding the applicable surcharge is displayed at the cashier.
3.4. Crown will not accept deposits or withdrawals from your Crown Wallet by or to a person other than you. Crown may require you to provide Acceptable Identification in order to process a Transaction using your Crown Wallet.
4. WITHDRAWING FUNDS FROM YOUR CROWN WALLET
4.1. The withdrawal of all or part of the balance of funds in your Crown Wallet can be done:
4.1.1. in person at the Crown Melbourne Casino cashier in cash (up to $1,000 or other lesser amount determined by Crown Melbourne cashier team members in their sole discretion), cheque or via EFT to your verified Bank Account;4.2. Before you can withdraw funds from your Crown Wallet via EFT to your Bank Account, your Bank Account must be verified.
4.2.1. To verify your Bank Account you must attend the Crown Melbourne Casino cashier with Acceptable Identification, details of your Bank Account (including a Bank Account statement from within the last 12 months which clearly displays your full name and details of your Bank Account including bank name, the BSB and account number and account type) and such further information as may be required by Crown for the purposes of verifying your Bank Account.
4.3. Withdrawal Transactions via EFT are processed on business days and are subject to bank processing times. Funds will be available in your account after 24 hours.
4.4. Crown may require you to provide Acceptable Identification in order to process a withdrawal Transaction.
4.5. Withdrawal Transactions are subject to the requirements of any applicable laws and / or the requirements or directions of any regulatory authority.
5. CONDITIONS OF USE OF YOUR CROWN WALLET
5.1. The deposit of funds into your Crown Wallet are a pre-payment of credits for your participation in gaming activity at Crown Melbourne Casino and are non-refundable and cannot be cancelled, except in the case of transactional error (in Crown’s sole discretion). You must notify Crown of any such error at the earliest opportunity and prior to any of the deposited funds having been used for play or otherwise withdrawn. A cancelled deposit Transaction may only be payable in accordance with clause 4 and may not be refunded to your Debit Card or Bank Account, unless the funds have not been credited to your Crown Wallet.
5.2. If you dispute a Transaction relating to funds that have been deposited or withdrawn from your Crown Wallet, Crown reserves the right to suspend your Crown Wallet and / or access to Crown Melbourne Casino without notice pending Crown’s investigation of the Transaction.
5.3. A Transaction may be delayed, blocked, frozen or refused by Crown or the Payment Services Provider in their sole discretion. Crown will have no liability for any losses suffered by you in connection with the delay, block, freeze or refusal of a Transaction. Crown will not provide reasons for any decision or action taken by Crown or its Payment Services Provider in respect of a Transaction. Crown will have no liability if Crown makes a transfer or seeks to return funds to you in accordance with these Terms and Conditions and the funds are not received by you.
5.4. During any period of technical malfunction resulting in Crown Wallet being unavailable, you may not be able to access your funds until the issue is resolved. Crown will not be liable for any loss that you suffer as a result of, or in connection with your Crown Wallet being unavailable.
5.5. You must not establish or attempt to establish any automatic deposit transactions for the purpose of funding your Crown Wallet. Crown reserves the right to suspend or cancel your Crown Wallet and / or access to Crown Melbourne Casino without notice if Crown or its employees, in their sole discretion, form a suspicion that you have established an automatic deposit transaction for the purpose of funding your Crown Wallet.
5.6. You must not conduct, or request that Crown conducts, any Transaction with your Crown Wallet that is not directly related to your gaming activity at Crown Melbourne Casino. You must not use your Crown Wallet for any other purpose other than to fund your own gaming activity at Crown Melbourne Casino.
5.7. Crown will not accept any Transaction if the funds are from a third party, from a credit account or credit card.
5.8. By undertaking a Transaction you represent and warrant to Crown that:
5.8.1. You are the lawful owner of the funds you deposit or withdraw from your Crown Wallet.
5.8.2. You are not entering into a Transaction on behalf of, under the direction of or for the benefit of any other party.
5.8.3. You have not and will not enter into agreements with any other party regarding the use of your Crown Wallet.
5.8.4. You will ensure that no other party uses your Crown Wallet or undertakes a Transaction.
5.9. Crown does not receive or hold funds on trust for you. Your Crown Wallet and any Transactions do not constitute a trust or agency relationship between you and Crown.
5.10. Funds in your Crown Wallet do not accrue interest.
5.11. Crown may adjust or remove Transactions incorrectly made to your Crown Wallet.
5.12. Crown may, in its sole discretion, immediately suspend or terminate (at Crown’s option) your Card or your Crown Wallet for any reason including (but not limited to):
5.12.1. if you are excluded or have your licence to enter Crown Melbourne withdrawn;
5.12.2. if you do not comply with these Terms and Conditions or with any law applicable to your use of the Crown Wallet;
5.12.3. if you die or become bankrupt;
5.12.4. if Crown has concerns about your gaming activity, including where Crown considers you may be displaying signs of gambling harm;
5.12.5. if you engage in conduct which, in Crown Melbourne’s reasonable opinion, is dishonest, fraudulent, offensive, disruptive or intimidating; or
5.12.6. where required by law, by law enforcement or by any regulatory authority.
5.13. Crown will not provide reasons for any decision or action taken by Crown to suspend or terminate your Card or Crown Wallet. If Crown suspends or terminates your Crown Wallet, subject to requirements of any applicable law and / or requirements or directions of any regulatory authority, Crown may elect to return the funds in your Crown Wallet to your verified Bank Account (if applicable) or otherwise in a manner of Crown’s choosing.
6. DELAYS IN ACCESSING FUNDS FOR GAMING
6.1. Subject to the Terms and Conditions, for any second or subsequent deposit in a calendar day, a delay of 15 minutes will be applied. This means that the deposited funds in your Crown Wallet will not be available for gaming for a period of at least 15 minutes following the transaction.
6.2. A delay will not be applied to your first deposit Transaction of the calendar day. This means that these funds will be available in your Crown Wallet for gaming immediately following the processing of the deposit Transaction.
6.3. A delay will not be applied for a deposit of any of your winnings at Crown.
7. DORMANT ACCOUNTS
7.1. If there are funds in your Crown Wallet, and Crown considers that your Crown Wallet may be dormant (including where you have not Transacted using your Crown Wallet for a period of 180 days or more), subject to requirements of any applicable law and / or requirements or directions of any regulatory authority, Crown may elect to return the funds to the verified Bank Account linked to your Crown Wallet (if applicable). Otherwise, Crown will attempt to contact you to arrange for the return of your funds.
7.2. If Crown cannot contact you, subject to any applicable law and / or requirements or directions of any regulatory authority, Crown may close your account and will return your funds, less any Account Closure Fee which is payable, to you in a manner of Crown’s choosing.
7.3. Crown reserves the right to revoke access to or close a Crown Wallet that has become inactive.
7.4. Crown will debit the Account Closure Fee from any Crown Wallet that Crown closes due to inactivity or otherwise in accordance with these Terms and Conditions. The Account Closure Fee may be waived in Crown’s sole discretion.
8. DEPOSIT LIMITS
8.1. Members of the Crown Melbourne Casino may elect to set a Deposit Limit, or they can elect to opt out of setting a deposit limit.
8.2. If you elect to set a Deposit Limit, it is your responsibility to determine the amount of any Deposit Limit having regard to your individual circumstances.
8.3. You may set a Deposit Limit, change a Deposit Limit you have set or opt out of setting a Deposit Limit at any time. You can set or change your Deposit Limit, or opt out of setting a Deposit Limit, by visiting, the Crown Melbourne Casino cashier. If you wish to change a Deposit Limit you have set, a decrease in your Deposit Limit will apply immediately following the actioning of your request by Crown, but an increase in your Deposit Limit will not take effect until after 24 hours following the actioning of your request by Crown.
8.4. External funding into the Crown Wallet will not be available if you do not set a Deposit Limit or expressly advise Crown that you do not want to set a Deposit Limit.
8.5. Crown Melbourne will periodically send you information regarding the benefits of Deposit Limits. You consent to Crown Melbourne sending you this information including by electronic means such as text, or email.
8.6. You must not attempt to exceed any Deposit Limit you have set. Crown is not liable to you for any loss suffered in connection with any action taken by Crown or its employees for the purpose of implementing any Deposit Limits set by you.
8.7. Any funds transferred to your Crown Wallet from an external bank account (including via direct deposit or other external bank transfer methods) will be treated as a deposit for the purposes of your Deposit Limit and will count towards your applicable daily Deposit Limit.
8.8. Crown may in its sole discretion place a limit on the maximum fund balance that can be held on or transferred to your Crown Wallet. Crown may reject any Transaction that could result in the balance of your Crown Wallet exceeding a maximum limit or transfer any funds exceeding the maximum limit to you in a manner of Crown’s choosing.
9. LIMITATION OF LIABILITY AND INDEMNITY
9.1. Subject to this clause 9, you will be responsible and liable for any Transaction or use of your Crown Wallet.
9.2. Nothing in these Terms and Conditions is intended to affect any rights you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) and the Australian Consumer Law and Fair Trading Act 2012 (VIC) which cannot be excluded.
9.3. Without limiting any other provision in these terms and conditions but subject to clause 10.2, to the maximum extent permitted by law, Crown, its related bodies corporate and its officers, employees, agents and contractors are not and will not be liable for any damages or any other loss incurred by you (including consequential loss) either directly or indirectly arising in connection with these Terms and Conditions or any Transaction or use of your Crown Wallet, except to the extent caused by the negligence, wilful misconduct or wrongful act or omission of Crown, its related bodies corporate or its officers, agents or employees.
9.4. You indemnify Crown against any claim, action, damage, loss, liability, cost or expense (including legal costs on a full indemnity basis) which Crown or its related bodies corporate pay, suffer, incur or are liable for, in respect of:
9.4.1. any breach by you of these Terms and Conditions or any law applicable to your use of the Crown Wallet;
9.4.2. the dishonour or reversal of any Transaction;
9.4.3. the enforcement, protection or waiver of, or the attempted enforcement or protection of, any rights or powers of Crown under, or in connection with, these Terms and Conditions or your use of the Crown Wallet; and
9.4.4. any tax (including goods and services tax), duty, charge, impost, or withholding incurred, payable or deducted by Crown under, or in connection with, your use of the Crown Wallet.
9.5. If at any time Crown receives from you any amount which is not in Australian dollars, you indemnify Crown against any shortfall between the amount payable in Australian dollars and the amount actually received or recovered by Crown after the payment currency is converted into Australian dollars.
10. GENERAL
10.1. These terms and conditions are governed by the laws of Victoria. Each party submits to the jurisdiction of the courts of that State and of any court that may hear appeals from any of those courts, for any proceedings in connection with these terms and conditions.
10.2. To the extent that any provision in these Terms and Conditions is illegal or unenforceable, it is severed without affecting the validity or enforceability of the remaining provisions of the Terms and Conditions.
10.3. Crown may, in its sole discretion, waive or modify the application of a provision of these Terms and Conditions in respect of a Member. Any such waiver does not operate as a waiver of such right, requirement, application or compliance if it arises again.
11. DEFINITIONS
Acceptable Identification means such current and valid forms of identification as Crown requires in its sole discretion from time to time. Such Acceptable Identification must be valid and current and. Crown may in its sole discretion choose not to accept identification that is provided in digital form only and may require a physical form of identification to be provided.
Account Closure Fee means a fee calculated as the lesser of $10.00 or the balance remaining in the Account.
Account means your account used for gaming at the Crown Melbourne Casino, otherwise referred to as the Crown Wallet.
Bank Account means your personal account that you hold with a bank or other financial institution.
Bank means the bank with which you hold your Bank Account.
Card means the card issued to you by Crown which is linked to your Account.
Crown means Crown Melbourne (Crown Melbourne Limited ABN 46 006 973 262).
Crown Rewards means the customer loyalty program known as “Crown Rewards” operated by Crown.
Crown Rewards Rules means the Crown Rewards Rules available on the Website.
Crown Melbourne Casino means Crown Melbourne Casino situated at 8 Whiteman Street, Southbank, Victoria, Australia.
Crown Wallet means the cashless deposit and withdrawal functionality which allows for funds to be deposited or withdrawn directly to or from your Card for certain gaming activity in the Mahogany Room at Crown Melbourne Casino.
Debit Card means a debit card issued to you and which you have authorised for use in the Transaction using that debit card.
Deposit Account means a deposit account established at Crown in accordance with the Deposit Account Terms and Conditions available on the Website.
Deposit Limit means the maximum amount of money from an external funding source (including from cash, your Bank Account and your Debit Card) that you can deposit in a calendar day into your Crown Wallet.
Mandate Management Service means the central database operated by NPP where details of PayTo Payment Agreements are stored.
Member is a person who has applied for and been accepted by Crown as a member of Crown and continues to hold such Membership (whether or not they choose to opt-in or opt-out of Crown Rewards).
Membership means membership in Crown Rewards.
NPP means the New Payments Platform operated by NPP Australia Limited ABN 68 601 428 737.
PayID means the identifier that you choose to receive PayID payments. PayID is a registered trademark of NPP Australia Limited.
Payment Services Provider means the third party or third parties engaged by Crown from time to time to facilitate electronic payments for Crown and includes the provider of Crown’s banking services from time to time.
Privacy Policy means the Crown Melbourne Privacy Policy available on the Website.
Terms and Conditions means these terms and conditions any terms and conditions which are connected to your Membership and your gaming activities at Crown Melbourne Casino including (as applicable), the Crown Rewards Rules, and the Deposit Account Terms and Conditions.
Transaction means any transaction involving the funds in your Crown Wallet, including a deposit or withdrawal transaction. Transact and Transacted have a corresponding meaning.
